Lack of FDA Regulation Makes the CBD Market a Free-for-All
Because CBD, or cannabidiol, is derived from hemp and marijuana, the government originally treated it more like a drug and not as a dietary ingredient. This led to the environment that exists today, where lack of clear FDA guidance and control over CBD products has allowed companies to do almost anything they want as far as labeling their products.
This has put consumers in a position of not really knowing if the CBD product they purchased truly contains the amount of CBD the label indicates. The products may also contain other elements that are not disclosed on the label.
Today state and federal governments are trying to play catch-up on the issue. Some states are attempting to regulate the testing and purity of CBD products to ensure their safety and to ensure consumers have accurate information.
CBD Oil vs. Hemp Oil
While CBD oil and hemp oil come from the same plant, the two products are entirely different. Hemp oil is sourced solely from hemp seeds. CBD oil is extracted from stems, leaves and flowers. Hemp oil does not contain any CBD. So, a product containing only hemp oil cannot truthfully be sold as a CBD oil.
However, because of the uncertainty around CBD, some companies have advertised and sold hemp products as CBD products and vice-versa. This is false advertising and a deceptive business practice, and consumers have a right to challenge such practices with the help of an attorney.
