Wells Fargo Sued For Spam Text Messages

While Wells Fargo does offer a free service to its customers known as “text banking” in which customers are able to receive account information via text message.  In order for this service to comply with the Telephone Consumer Protection Act, (TCPA),  customers must enroll in the program in order to receive the messages.   Additionally, under the FCC’s rules, consumer consent for commercial texts promoting a product or service must be in writing.   Furthermore, the TCPA and the FCC both ban most text messages sent to a mobile phone using an autodialer.

This new class action lawsuit investigation alleges that Wells Fargo Bank has been illegally sending unsolicited text messages to customers without their prior consent.

TCPA violations can carry penalties of $500 per violation or up to $1,500 if it can be proven that the company knowingly violated the law.
