Multi-Million Dollar Settlement Reached in a Class Action Lawsuit Against Steve Madden for Sending Spam Texts

A $10 million settlement has been reached in a class action lawsuit filed against shoe designer Steve Madden, Ltd.,  after allegations that countless unsolicited spam text messages were sent to consumers.  These text messages were considered to be spam in violation of  the Telecommunications Privacy Act, which prohibits unsolicited text messages to cell phones.

According to court documents, Steve Madden, LTD sent hundreds of unsolicited text messages to consumers advertising the company’s shoes and promotional events.

Steve Madden has offered a $10 million proposed settlement, which has been submitted to the court overseeing the case for approval.  A fairness hearing, which is designed to give opposing class members an opportunity to be heard, is scheduling for February 25, 2013.  If it is approved, class members may be eligible to recover under the class settlement if they submit a valid Claim Form by April 11, 2013.   Class members include “All Persons Nationwide who were sent any Text Message(s) promoting Steve Madden products and events from short codes 91919 or 623336 from July 2010, until September 25, 2012.
