Junk Fax Class Action Lawsuit Filed

A class action lawsuit has been filed against Forest Laboratories following allegations that the pharmaceutical company sent junk faxes in  violation of the Telephone Consumer Protection Act (TCPA). St. Louis Heart Center Inc. v. Forest Pharmaceuticals Inc., et al., Case No. 12-cv-02224,

The lead plaintiffs in the lawsuit, allege they received 40 junk faxes from Forest Labs promoting its hypertension medication Bystolic, as well as invitations to teleconferences and presentations.

The plaintiff claims that these faxes are in violation of the TCPA, which prohibits companies from sending unsolicited advertisements via fax.

The TCPA lawsuit is brought on behalf of anyone who received a junk fax advertisement from Forest or co-defendant The Peer Group within the last 4 years without giving prior permission or having an existing business relationship with the defendants.
